What We Do

   

The book guides you through the process our office takes in handling most of our personal injury cases. This assists the reader in understanding the specific tasks that must be completed in most personal injury cases in Wisconsin. The book explains the different stages of most cases and then provides a list of the different tasks that need to be completed at each of these stages. The stages are as follows:

 

These stages and a sample of the tasks follow (note this is not the exhaustive list that appears in the book):

  • Initial telephone consultation with the potential client (No charge if case is declined)
  • Face-to-face meeting with the client
  • Educate client about personal injury claims in general and their particular case in more specific terms, including any potential statute of limitations
  • Investigate the accident and gather necessary documentation, including accident reports, incident reports and witness statements
  • Retain professional investigator and/or accident reconstructionist to gather critical evidence

  • Obtain all medical records, medical bills, out-of-pocket expenses
  • Contact treating physicians and experts to obtain reports documenting the injuries, losses, harms, and future damages
  • Consult with the client and decide together whether an attempt will be made to negotiate the case with the insurance company or whether to file a lawsuit immediately
  • If it has been agreed that a “demand” will be made to the insurance company, then we will prepare a comprehensive settlement demand package that itemizes and accounts for all elements of damages including any property damages, out-of-pocket expenses, past and future medical expenses, past and future wage loss, and past and future pain and suffering (Note: It has become increasingly rare for permanent injury cases to be resolved short of filing a lawsuit.)

  • Negotiate with the responsible party or the insurance adjuster in an attempt to resolve the case
  • Negotiate with all other entities that make a claim for repayment out of settlement, i.e. health insurance carriers, Medicare, Medicaid, etc.

  • Prepare the client, witnesses and healthcare providers for the litigation process
  • Investigate the proper legal entities and the proper legal names of all parties involved, including valid subrogated parties
  • Prepare and draft the summons and complaint, stating the allegations of negligence and damages
  • Prepare written interrogatories for the defendants to answer
  • Prepare requests for production of documents that the defendants must provide
  • Discuss with the client all options for potential venue for the case and advise the client as to the best possible venue for his or her particular case, i.e. State or Federal Court and, if State Court, the most favorable county
  • File the lawsuit in the agreed upon venue

  • Advise the client on the likelihood of a successful appeal
  • If we and the client agree to pursue the appeal, then the client signs a fair and reasonable retainer agreement for the purposes of the appellate representation
  • Prepare a comprehensive brief of the appellate issues
